Eventagram is a photo-sharing platform that allows event hosts to create digital spaces where guests can easily upload and view photos — no apps, no accounts, just scan and go.

These Terms of Service ("Terms") govern your access to and use of our website [https://eventagram.app], services, and any associated tools (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not accept them, you may not use the platform.

If you’re using the Services on behalf of a company or another legal entity, you confirm that you have the authority to bind that entity to these Terms.

You must be at least 18 years old to use Eventagram. If you are under 18, you may only use the Services with parental or guardian consent.

2. Use of the Services Eventagram grants you a limited, non-exclusive, non-transferable license to access and use the Services for sharing and viewing media related to events you host or attend.

You agree not to:

Use the Services to host or store unrelated files (e.g., backups, personal galleries).

Interfere with the functionality or security of the platform.

Attempt to access data not intended for you.

Use bots, scripts, or automation tools to upload content, unless explicitly authorized.

Use the Services to build or enhance a competing platform.

3. User-Generated Content You are solely responsible for all content uploaded through your events (“User Content”). You confirm that you either own or have the necessary rights to upload, share, and display that content.

You agree not to upload or allow uploads that:

Violate any law or regulation.

Infringe on copyrights, trademarks, or intellectual property rights.

Contain nudity, hate speech, harassment, illegal activities, or discriminatory content.

Are spammy or promotional in nature.

Violate privacy rights of others.

Eventagram does not pre-screen content but reserves the right to remove content that violates these Terms and to suspend or terminate events or accounts at our discretion.

You retain all rights to your content. By uploading to Eventagram, you grant us a non-exclusive, royalty-free license to store and display your content for the purpose of delivering the Services.

4. Fair Usage Policy Eventagram is designed to support real events. To keep things fair for all users, we apply reasonable limits even on “Unlimited” plans:

Max 10,000 uploads per event

Max 5,000 guests per event

Exceeding these thresholds may result in upload restrictions or require a custom plan. Contact us at info@eventagram.be if you need higher limits.

We also don’t allow the platform to be used as a general-purpose cloud drive.

Eventagram may suspend or remove any event or account that violates this policy without prior notice.

5. Refund Policy Sometimes things don’t go as planned — we get that. If your event ends and fewer than 25 photos have been uploaded, you're eligible for a full refund. No questions asked.

To request a refund, send us an email at info@eventagram.be with your event link or order reference. We’ll handle it from there.

6. Payments Access to certain features may require payment. By purchasing a paid plan, you agree to the pricing outlined on our website at the time of purchase. All fees are non-refundable unless otherwise stated in our refund policy.

Eventagram reserves the right to change pricing or introduce new features under different pricing models, with reasonable notice to users.

7. Account Registration Some features require account registration. When signing up, you agree to provide accurate, complete information and to keep it up to date. We reserve the right to suspend or delete accounts with false or misleading information.

You are responsible for any activity that occurs under your account.

8. Privacy Policy Your privacy matters to us. Our Privacy Policy, available at https://eventagram.app/privacy, outlines how we collect, use, and protect your data. By using Eventagram, you agree to our privacy practices.

9. Service Availability Eventagram uses third-party hosting and infrastructure providers. While we aim for high uptime and reliability, we can’t guarantee uninterrupted access. We are not liable for any downtime or data loss resulting from external infrastructure failure.

10. Intellectual Property All code, design, trademarks, branding, and related materials provided by Eventagram are owned by Eventagram BV. You may not copy, distribute, or create derivative works without prior written permission.

11. Warranty Disclaimer You use Eventagram at your own risk. The Services are provided "as is" and without warranties of any kind — either express or implied — including merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the platform will be free of bugs, errors, or interruptions.

12. Limitation of Liability To the fullest extent permitted by Belgian law, Eventagram shall not be liable for any indirect, incidental, special, or consequential damages — including loss of data, loss of profits, or service interruptions — arising from your use of the Services.

Our total liability under these Terms shall not exceed the amount paid by you to Eventagram in the 12 months prior to the claim.

13. Termination We reserve the right to suspend or terminate your access to Eventagram if you violate these Terms or misuse the platform. We may also discontinue the Services at any time, with or without notice.

You may stop using the Services at any time.

14. Changes to These Terms We may update these Terms from time to time. If we make significant changes, we’ll notify users via the platform or email. Continued use of the Services after changes go into effect means you agree to the new Terms.

15. Governing Law These Terms are governed by the laws of Belgium, without regard to conflict of law principles. Any disputes shall be handled by the competent courts of Veurne, Belgium.
